Voluntary written agreement
Where the weekly limit applies, an adult worker may choose to agree in writing to work more than 48 hours a week on average. Choosing whether to opt out is voluntary, and a worker must not be treated unfairly for refusing. A genuinely self-employed subcontractor may have different rights; the actual working arrangement matters, not just the label used. Some types of work cannot use an opt-out, and other working time protections still apply.
Ending an opt-out
A worker may cancel a written opt-out at any time by giving written notice to the party with whom they made the agreement. The law requires at least seven days’ notice; a written agreement may set a longer period, up to three months.
Subcontractor arrangements
Subcontracting businesses are responsible for managing the working time of people they employ or engage and for any written opt-out agreements that apply. Contact us if project scheduling raises a working time concern. An opt-out is not required to browse this website or make an enquiry.
